The photo is taken by Lewis Hine (1874-1940) one of the best photographers ever existed, the photo is taken while the construction workers of the Empire State Building were taking a lunch brake. Hine was taking photos of the lower working class and his photography influenced a lot of labor laws in the United States, so he was very political, kind of like Banksy today ! (If you have never herd of Banksy or Lewis Hine I advice you to google them you will be highly impressed.)
